By purchasing or using any bat rolling, glove break-in, or other performance or “enhanced” service or product from Limit Break Diamond (a DBA of Limit Break Ascend Group LLC — “we,” “us,” “our”), you (“you,” the “Customer”) acknowledge and agree to all of the terms below.
1. What our services are — and are not
Bat rolling is a controlled process that accelerates the natural break-in of a composite bat’s barrel by flexing the fibers — the same thing that happens over hundreds of real swings. We do not shave the bat, cut it, remove the end cap, thin the walls, or otherwise physically alter its structure. Glove break-in uses conditioning oil and mechanical shaping to soften and form the leather. These are break-in and conditioning services performed on your equipment at your request.
2. League & tournament rules are your responsibility
Many sanctioned organizations — including but not limited to USSSA, USA Baseball, USA Softball (ASA), NSA, NFHS, and various youth and little leagues — set equipment and bat-compression standards, and some restrict or prohibit the use of rolled bats. A broken-in bat may test below certain leagues’ compression limits.
It is your sole responsibility to know and comply with the rules of any league, tournament, or organization in which you or anyone else uses the equipment. We make no representation or warranty that any enhanced bat or product is approved, certified, or legal for use in any sanctioned play. You agree not to use any enhanced product where it is prohibited and accept full responsibility for the consequences of doing so. Our services are intended for practice, training, recreational, and home-run-derby use.
3. Assumption of risk
Baseball, softball, and the use of bats and gloves carry inherent risks, including property damage and personal injury. You understand these risks and voluntarily assume all risk associated with the purchase, possession, and use of any enhanced product, whether used by you or by anyone else.
4. Release, indemnification & hold harmless
To the fullest extent permitted by law, you release, waive, and discharge, and you agree to indemnify, defend, and hold harmless Limit Break Diamond, Limit Break Ascend Group LLC, and their owners, members, managers, employees, and agents (the “Released Parties”) from and against any and all claims, demands, causes of action, damages, losses, liabilities, penalties, disqualifications, costs, and expenses (including reasonable attorneys’ fees) of any kind — including those arising from personal injury, death, or property damage — that arise out of or relate to any enhanced product or service, or its use or misuse, whether that use is legal or illegal, and regardless of any alleged negligence of a Released Party.
5. No warranty; performance not guaranteed
Enhanced services permanently affect the item, are final sale, and void the manufacturer’s warranty. We make no guarantee of any specific result — exit velocity, distance, or compression figure. Rolling and continued use may reduce a bat’s lifespan and durability. Composite bats generally perform best above roughly 60°F; using a bat in cold conditions increases the risk of cracking and is at your own risk.
6. Damage from use
We are not responsible for cracking, denting, breakage, or other damage that occurs during or after use of any enhanced product. Any workmanship concern must be raised with us within a reasonable time, and our maximum responsibility is limited, at our discretion, to re-performing the service.
7. Eligibility
You represent that you are at least 18 years old, or that a parent or legal guardian has reviewed and agreed to these terms on behalf of a minor.
8. Governing law
This agreement is governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute shall be brought exclusively in the state or federal courts located in Collin County, Texas. If we must enforce this agreement, you agree to pay our reasonable attorneys’ fees and costs.
9. Your consent
By purchasing or ordering any enhanced service or product from us — and, where presented, by checking the acknowledgment box at checkout — you confirm that you have read, understood, and agree to this Disclaimer, Consent & Release, and that your electronic acceptance is a binding signature with the same effect as a handwritten one.
